IDAHO SECRETARY OF STATE AGREES TO E-SIGNATURES FOLLOWING DEPARTMENTAL ANALYSIS AND ADVICE FROM ATTORNEY GENERAL IN RESPONSE TO REQUEST FROM RELIANT REGISTERED AGENT, LLC

December 16, 2015

Dear [Reliant],

Thank you for sending the link to the Adobe electronic signature scenario that you are considering using.  I passed your example along to my team, and it has given us a great opportunity to not only review our processes and existing procedures in light of accepting electronic signatures, but also to get some clarification from the Idaho Attorney General as well.

In short, your process as you described will actually be completely acceptable as a form of signature, as you had suggested, and is in compliance with Idaho statutes regarding electronic signatures.

Our business department has additionally been briefed on the Attorney General's response to our questions, and stands ready to accept any electronic signatures from you and your clients!

Thank you again for bringing this to my attention and for the opportunity to serve you in this area.  We appreciate you giving us the time to get the full and correct answers needed, and wish you success with your registered agent company.

I have attached a copy of the Deputy Attorney General's response for your review...

Sincerely,

Lawerence Denney

Following a detailed request and numerous communications directly with Idaho Secretary of State,  Reliant Registered Agent, LLC received the above news directly from Secretary Denney.

Reliant Registered Agent employs an on-line signature program that is the first to have been reviewed and approved by the Idaho Secretary of State's Office.  Reliant is ready to help you through your Idaho filings using our newly approved and convenient process that utilizes the trusted Adobe Document Cloud eSign product.  There is no need for customers to purchase Adobe's product in order to generate approved filings with Reliant Registered Agent, the link above has simply been provided for your reference and convenience.

The Idaho Secretary of State's Office now accepts all forms of electronic signatures (e-signatures) generated by business entities filing applications, forms and other business documents in Idaho.  This includes typed signatures entered in an on-line form.  Previously in Idaho, the only signatures accepted by the Idaho Secretary of State's Office had to be generated by hand and then mailed or faxed to the Office.  This created many extra steps and slowed down the filing process for business entities.  Many thanks to Secretary Denney and his staff for their diligence and desire to improve Idaho's business environment!

To our clients, thank you for trusting Reliant with your business filings and registered agent services.  We will continue to work with the Idaho Secretary of State, as well as other secretaries of state, on your behalf and on behalf of our industry wherever we operate.

Sincerely,

Reliant Registered Agent, LLC
